1. Who we are
Little Bird Studio ("Little Bird", "we", "us") is operated by Little Bird Studio. You can contact us at support@littlebirdstudio.app.
These Terms of Service ("Terms") govern your access to and use of https://littlebirdstudio.app and the image editing services offered through it (the "Service"). By creating an account or using the Service, you agree to these Terms.
2. The Service
The Service uses artificial intelligence to help you clean up backgrounds, enhance images, render higher-resolution files, resize assets for different channels, and apply custom edits. AI outputs are probabilistic: results vary, may contain artefacts, and may not match your expectations. We do not guarantee that any particular edit will be accurate, complete, or suitable for a particular purpose.
We may change, suspend, or discontinue features at any time. We aim to give reasonable notice of material changes where practical.
3. Accounts
You must be at least 18 years old and legally able to enter into a contract to use the Service. You must provide accurate account information and keep your password secure.
You are responsible for activity under your account. Tell us promptly if you believe your account has been compromised. We may suspend accounts that breach these Terms or the Acceptable Use Policy.
4. Free credits and paid plans
New accounts receive 3 free edits. Free credits have no cash value, are non-transferable, and may be changed or withdrawn for future accounts.
Paid plans are not currently available for purchase through the Service. When paid plans become available, the pricing page and checkout will set out the applicable price, billing period, and inclusions. Credits are consumed when an edit is successfully started; failed edits are returned automatically.
5. Your content
You retain ownership of the images you upload and the outputs you create. You grant us a limited, non-exclusive licence to host, transmit, process, and display your content solely to provide the Service.
You represent that you have all rights needed to upload your images and to authorise their processing, including any rights in people, products, logos, text, or other protected material shown in them.
6. AI outputs and commercial use
AI-generated outputs may resemble outputs created for other users. We do not guarantee that an output is unique or that it does not unintentionally reproduce protected material. You are responsible for reviewing outputs before use.
Your ability to use outputs commercially depends on the rights you hold in the input image, the instructions you provide, and the terms of our AI processing providers. We do not grant you rights in third-party material that appears in an output.
7. Our intellectual property
The Service, including the Little Bird Studio name, logo, website design, software, and documentation, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, revocable, non-exclusive licence to use the Service for its intended purpose.
8. Third-party services
We use third-party providers for email delivery, hosting, and AI inference. Their services may be subject to their own terms and availability. We are not responsible for third-party outages, but we will make reasonable efforts to keep the Service available.
9. Disclaimers
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
We do not provide legal, copyright, or compliance advice. You are responsible for clearing rights and for complying with the rules of the platforms where you publish your assets.
10. Limitation of liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability arising out of or relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or USD 50.
Nothing in these Terms limits liability that cannot be limited by law.
11. Indemnity
You agree to indemnify and hold us harmless from claims, losses, and expenses (including reasonable legal fees) arising from your content, your use of the Service, or your breach of these Terms or the Acceptable Use Policy.
12. Termination
You may stop using the Service at any time and may delete your account from the account page. We may suspend or terminate access if you breach these Terms, if required by law, or if your use creates risk for us or others.
On termination, your right to use the Service ends. Sections that by their nature should survive (including ownership, disclaimers, liability, and indemnity) will survive.
13. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you. Continued use after the effective date means you accept the updated Terms.
14. Governing law
These Terms are governed by the laws of Singapore, without regard to conflict-of-law rules. Courts located in that jurisdiction will have exclusive jurisdiction, unless mandatory consumer law provides otherwise.
